Dabi Atlante has been in the market for more than 70 years and, along this history, has always had the protection and respect for the rights of its consumers. Here at the Virtual Store it couldn't be different.

The terms used in this Privacy Policy will have the meanings defined below:

Treatment agents: the controller and the operator;

Anonymization: use of reasonable and available technical means at the time of treatment, through which a data loses the possibility of association, directly or indirectly, to an individual;

National authority: the public administration entity responsible for overseeing, implementing and supervising compliance with this Law throughout the national territory;

Blocking: temporary suspension of any processing operation, by guarding personal data or the database;

Controller: natural or legal person, of public or private law, to whom the decisions regarding the treatment of personal data are incumbent;

Child and Adolescent: according to the Statute of the Child and Adolescent, a child is considered a person up to twelve years of age, and an adolescent is considered a person between twelve and eighteen years of age;

Dabi Atlante: Brand owned by the company ALLIAGE;

Anonymized Data: Data related to the holder that cannot be identified, considering the use of reasonable and available technical means at the time of its treatment;

Personal data: information related to an identified or identifiable natural person;

Sensitive personal data: personal data about racial or ethnic origin, religious conviction, political opinion, union membership or religious, philosophical or political organization, data related to health or sexual life, genetic or biometric data when linked to a natural person;

Elimination: exclusion of data or set of data stored in a database, independent of the procedure applied;

Handler or DPO: person indicated by the controller and operator to act as a communication channel between the controller, data holders and the National Data Protection Authority (ANPD);

Information: Anonymized data that shows the behavior of the users on the websites, that is, the pages displayed and browsed by the user on the websites, their length of stay and the path taken;

IP: Internet Protocol, an address assigned to each device (cell phone, personal computer, tablet, among others) in order to identify it in the world wide web;

General Law of Personal Data Protection or LGPD: Law No. 13.709 of August 14, 2018, known as LGPD;

Operator: natural or juridical person, of public or private law, who performs the treatment of personal data in the name of the controller;

Research Organ: body or entity of the direct or indirect public administration or legal entity of private law without lucrative purposes legally constituted under the Brazilian laws, with headquarters and jurisdiction in the Country, which includes in its institutional mission or in its social or statutory objective the basic or applied research of historical, scientific, technological or statistical character;

Policy: Designation given to this Privacy Policy;

Personal data protection impact report: controller's documentation that contains the description of the personal data processing processes that may generate risks to civil liberties and fundamental rights, as well as measures, safeguards and risk mitigation mechanisms;

SAC: Dabi Atlante's Customer Service;

Holder: natural person to whom the personal data that are the object of treatment refers;

International data transfer: transfer of personal data to a foreign country or international body of which the country is a member;

Treatment: any operation carried out with personal data, such as those referring to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination or extraction;

Shared use of data: communication, dissemination, international transfer, interconnection of personal data or shared processing of personal data banks by public bodies and entities in compliance with their legal powers, or between these and private entities, reciprocally, with specific authorization, for one or more types of processing allowed by these public entities, or between private entities;

User(s), You or Owner: Natural person who navigates on Dabi Atlante's Websites, owner of the personal data subject to treatment;

Websites: Dabi Atlante Websites to which this Policy applies, including their respective subdomains and hotsites, which are: Dabi Atlante.com.br.

  2. DATA COLLECTION

Dabi Atlante may collect Personal Data which includes, but is not limited to: name, marital status, personal data and document numbers (RG, CPF, CRO, functional identity number, passport, etc.), delivery address and geolocation, telephone numbers, e-mail address, contact preferences, credit card information, the IP address of the User's device/personal equipment, information about the pages displayed, length of stay and the path taken by the User on our Websites. This happens when the User creates an account, buys a product, contacts us or responds to an online survey.

Dabi Atlante may also collect Sensitive Personal Data of the User, especially those necessary for the creation of marketing campaigns, such as your personal preferences, supported by soccer team and / or other sports, among others, an opportunity in which we will inform you in advance, as well as collect your specific authorization, at your sole discretion, for this.

The User may choose not to provide certain personal information, but with this, he/she will also lose access to the specific functions and services of the site. We remind you that all personal information of customers or visitors who access this website will be treated in accordance with the Data Protection Law.

Automatic information:

We also receive and archive information about your activities on our site and when you interact with us. This data is used to understand the behavior of customers and, consequently, improve the experience of the site, as well as the products, services offered and actions of disclosure.

However, should any Personal Data of a Child or Teenager be (i) accidentally collected by Dabi Atlante, (ii) voluntarily provided by the Underage Holder and/or (iii) Dabi Atlante be misled in the collection of the Personal Data by the Child or Teenager, as soon as the situation and age of the Underage Holder are confirmed, such Personal Data will be immediately deleted from our databases.

Finally, according to §3 of article 14 of the LGPD: Personal Data may be collected from children without the consent referred to in § 1 of this article when the collection is necessary to contact the parents or legal guardian, used only once and without storage, or for their protection, and in no case may they be passed on to a third party without the consent referred to in § 1 of this article.

This also includes the exchange of information with other companies and organizations in order to protect against fraud and reduce credit risks - which does not allow the disclosure of personal data of customers for commercial purposes, because as clarified above, Dabi Atlante will never sell data of its Users.

If requested by a competent authority in the performance of its legal duties, or by order, decree, regulation or government rule, or in case of violations or suspected violations of this or the Law, Dabi Atlante may be required to provide the Information and Personal Data that are stored in our possession. Dabi Atlante, however, undertakes to strictly disclose the Information and Personal Data requested to achieve the required purposes.

Anonymized Data, such as statistical reports on access, use of the Website (and other Information) and market trends, which do not reveal the identity of the Users, may also be shared with Dabi Atlante's subcontractors or business partners.

As Dabi Atlante develops and grows, which may occur through, but not limited to, a corporate transaction, such as an acquisition, merger, spin-off or through the sale or purchase of companies, products and/or assets, the Holder's Personal Data may be transferred. c: correction of incomplete, inaccurate or outdated data;

d: anonimização, bloqueio ou eliminação de dados desnecessários, excessivos ou tratados em desconformidade com o disposto na LGPD;

e: portability of data to another service or product provider, upon express request, in accordance with the regulations of the national authority, observing commercial and industrial secrets;

f: elimination of personal data processed with the consent of the holder, except in the cases provided for in art. 16 of this Law;

g: information from public and private entities with which the controller has made shared use of data;

h: information about the possibility of not providing consent and about the consequences of denial;

i: revocation of consent, pursuant to paragraph 5 of art. 8 of this Law.

Requests will be answered within the shortest time possible and legally permitted. We clarify that in cases of request for deletion of Personal Data, we will respect the minimum period of storage of Information and Personal Data of Users of Internet applications, determined by Brazilian law.

It is important to clarify that the deletion of the User's Personal Data will automatically imply in the deletion of any user account created on our Website, as well as all data from your financial transactions generated within this environment.

  7. RETENTION OF PERSONAL DATA AND/OR SENSITIVE PERSONAL DATA

The Personal Data and/or Sensitive Personal Data will be kept by Dabi Atlante during the period necessary to comply with the purposes provided through LGPD and this Policy, or until eventually required the exclusion of such data by the User, when possible and applicable. The terms of our Privacy Policy may change without prior notice, which will be posted on this page. However, Dabi Atlante will always respect the terms of the General Law of Data Protection, and determinations of the National Authority of Data Protection - ANPD.
